Since January 2007, definitions used by the INSEE are derived from the OECD/Eurostat harmonised definitions.
ENTRIES
EXITSThe creation of an enterprise consist of the creation of a legal unit operating an activity which was not run by another enterprise beforehand. This creation process implies the creation of new production factors. Some adjustments are made to fit the EIP harmonised definitions:
A birth occurs when:
- new production factors are created (a new number is created in Sirene)
- An entrepreneur restart an activity after a break of more than one year (former number is used),
- an enterprise takes over all or parts of another enterprise (a new number is created) and at the same time there is no continuity of the former enterprise.
There is no continuity of an enterprise when at least 2 of the following 3 conditions are met: Change in the legal form controlling the enterprise, change in the economic activity and change in the geographic location.
Failures and cessations of activity are two different concepts.
Data on Failures refer to legal proceedings. Insolvency proceedings are initiated when an enterprise cannot guarantee the reimbursement of its debt. In most cases, bankruptcies do not end up with a liquidation.
The cessation of an activity occurs when the activity of an entreprise disappears. Liquidations that follow a bankruptcy represent a very limited number of cessations.
Data on bankruptcy includes all judgements on the openings of legal proceedings and immediate liquidations. They do not include information on the final decision (continuation, takeover or liquidation).
